How Jane Hay Limited collects, uses and protects personal data.
Who we are

- Property details relating to the searches you order
- Where you use our AML services: identity documents, verification data and, where you use source of funds verification, financial transaction data

- Technical data about your visit to this website, such as pages viewed
Why we use it, and our lawful basis
- To provide the services you have asked for — performance of a contract
- To respond to enquiries — legitimate interests, or steps prior to a contract
- To meet our obligations under money laundering regulations — legal obligation
- To keep records for accounting and tax — legal obligation
- To improve this website — legitimate interests
Who we share it with
To provide a search we pass the property address, and where necessary your reference, to the relevant third party: local authorities, water undertakers, the Coal Authority, HM Land Registry, and specialist data and report providers. For AML services we pass identity data to the verification providers we use.
We also use service providers for IT, hosting and payment processing, who act on our instructions. We do not sell personal data to anyone, for any purpose.
How long we keep it
Search records are retained for a period appropriate to potential claims and to our professional indemnity arrangements. Records held under money laundering regulations are retained for the period those regulations require, normally five years from the end of the business relationship or the completion of the transaction. Accounting records are kept for six years.
Where data is held
Data is held in secure cloud infrastructure. Where any provider processes data outside the UK, we ensure an appropriate transfer mechanism is in place.
Security
We hold Cyber Essentials Plus certification, which involves independent testing of our systems rather than self-assessment. Access to personal data is restricted to staff who need it to do their job.
Your rights
You have the right to ask for a copy of the personal data we hold about you, to have inaccurate data corrected, to ask us to delete data where we no longer need it, to restrict or object to processing, and to data portability in certain circumstances. Some of these rights are limited where we have a legal obligation to keep records — anti-money laundering records in particular.

Complaints
If you are unhappy with how we have handled your data, please tell us first so we can put it right. You also have the right to complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.
